Who we are

This notice applies to Vitality Kauai Metabolic, a physician-led body composition assessment and monitoring service located at 1 Hotel Hanalei Bay, 5520 Ka Haku Rd, Princeville, HI 96722. We are committed to protecting the privacy of your health information, and we are required by law to maintain its confidentiality, provide you this notice of our legal duties and privacy practices, and follow the terms of the notice currently in effect.

How we may use and disclose your health information

For treatment. We use your health history, DEXA scan results, and related information to provide your assessments and physician-reviewed reports. With your consent, we may share information with other health care providers involved in your care — for example, your primary care physician or a specialist you designate.

For payment. We may use and disclose your health information to bill and collect payment for the services we provide to you.

For health care operations. We may use your information for internal operations that support quality care, such as quality review, training, and administrative activities.

Appointment reminders and communications. We may contact you to remind you of scheduled appointments, share your results, or tell you about services that may be relevant to your care.

Other uses and disclosures. We will not use or disclose your health information for purposes not described in this notice without your written authorization. In particular, we will not sell your health information, and we will not use it for third-party marketing, without your written authorization. You may revoke an authorization at any time in writing, except to the extent we have already acted on it. Certain disclosures may be required by law — for example, for public health purposes, to prevent a serious threat to health or safety, or in response to lawful legal process.

Your rights regarding your health information

• Right to inspect and copy. You may request a copy of the health information we hold about you, including your scan reports. We will provide it promptly, usually within 30 days.
• Right to amend. If you believe information in your record is incorrect or incomplete, you may request that we amend it.
• Right to an accounting of disclosures. You may request a list of certain disclosures we have made of your health information.
• Right to request restrictions. You may request limits on how we use or disclose your information. We will consider all reasonable requests.
• Right to confidential communications. You may ask that we contact you in a specific way — for example, only by email, or only at a certain phone number.
• Right to a copy of this notice. You may request a paper copy of this notice at any time.
• Right to breach notification. We will notify you if a breach occurs that may have compromised the privacy or security of your information.

Our responsibilities

We are required by law to maintain the privacy and security of your protected health information. We will not use or share your information other than as described here unless you tell us we can in writing. We reserve the right to change the terms of this notice; the current version will always be posted on this page and available at our office.

If you have questions about this notice or believe your privacy rights have been violated, please contact us. You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights. You will not be penalized or retaliated against for filing a complaint.
